Some critics of the President appeared convinced that the eventual release of the records would produce a political earthquake capable of fundamentally damaging Tinubu’s standing.

But the latest development from the FBI has dramatically complicated those expectations.

The United States law-enforcement agency has asked a federal court in Washington, D.C., for permission to provide confidential explanations supporting its decision to withhold portions of records connected with an old investigation in which Tinubu’s name has featured.

That was always a dangerous assumption.

A Freedom of Information lawsuit is fundamentally a dispute over access to government records. It is not, by itself, a criminal trial determining whether the person mentioned in those records committed an offence.

The latest FBI position therefore demonstrates the difference between political expectations on social media and the considerably more complicated reality of American law.

The agency is not simply refusing disclosure without explanation. It is invoking established statutory exemptions and asking a federal judge to examine sensitive justifications privately.

For Tinubu’s political opponents who had hoped for an unrestricted document dump capable of dominating Nigeria’s political conversation, that development substantially alters the immediate landscape.

Exemption 7(F), meanwhile, permits withholding law-enforcement information where disclosure could reasonably be expected to endanger the life or physical safety of an individual.

These are established features of American freedom-of-information law and are not rules created specifically for the Tinubu controversy.

This is particularly important in understanding why the FBI wants part of its justification presented privately to the judge.

If explaining publicly why information is sensitive would itself reveal the very information the agency argues must remain protected, confidential judicial review becomes one mechanism for resolving the dispute.

The final determination, however, rests with the court.

Opposition Faces a New Political Reality

Politically, the development undoubtedly deprives Tinubu’s opponents of the immediate breakthrough some had anticipated.

For Tinubu’s supporters, the FBI development will inevitably be interpreted as a setback for those who had predicted that publication of the records would produce devastating revelations against the President.

They can legitimately argue that months of political speculation created expectations that have not materialised in the straightforward manner predicted.

But supporters should equally resist declaring the entire historical controversy legally extinguished.

What it has done is puncture expectations that the entire collection of disputed records could simply be released without legal restrictions.

With the 2027 presidential election approaching, virtually every controversy involving Tinubu is likely to acquire political significance.

The opposition will continue scrutinising the President’s record.

Tinubu’s supporters will equally challenge accusations they consider exaggerated or unsupported.
