Tinubu Wins US Court Ruling in FBI, DEA Records CaseHospitals

President Bola Ahmed Tinubu has recorded a significant procedural victory in the United States after a federal court rejected an application seeking to obtain evidence from him and an American lobbying firm, DCI Group, in an ongoing legal battle involving the Federal Bureau of Investigation (FBI) and the Drug Enforcement Administration (DEA).

The ruling, delivered on October 30, 2026, by the United States District Court for the District of Columbia, represents a setback for American transparency activist Aaron Greenspan, who has been pursuing access to government records relating to the Nigerian president.

However, the decision does not bring the wider Freedom of Information Act (FOIA) litigation to an end, as questions surrounding the disclosure of certain records remain before the American judiciary.

The latest development adds another dimension to the legal proceedings that have continued to attract public attention in Nigeria, particularly over the scope of information that American federal agencies may be required to disclose.

### Why US Court Rejected Request Against Tinubu

The controversy arose after Greenspan sought permission to obtain limited evidence from President Tinubu and DCI Group over alleged cyberattacks targeting his legal research website, PlainSite.

Greenspan had attempted to establish whether the Nigerian president, his representatives or other parties had any connection with the alleged digital attacks.

However, the court determined that the proposed inquiry was insufficiently connected to the central issues in the ongoing FOIA litigation.

The court’s position effectively prevented the plaintiff from expanding the existing information-disclosure lawsuit into an investigation of separate allegations concerning cyberattacks.

Importantly, the ruling did not establish who was responsible for the alleged attacks, nor did it amount to a judicial finding that Tinubu or DCI Group had participated in them.

### Presidency Welcomes Court Decision

The development was disclosed by the Special Adviser to the President on Information and Strategy, Bayo Onanuga, who communicated details of the ruling through his social media account.

The president’s legal representatives welcomed the decision, describing it as an important clarification of the boundaries within which the ongoing litigation should proceed.

One of Tinubu’s lawyers, Christopher W. Carmichael, maintained that the court had reinforced the principle that legal proceedings must remain focused on matters directly connected to the original dispute.

According to the legal team, the rejection of the discovery application demonstrated that unrelated allegations could not automatically become subjects of investigation within a FOIA lawsuit.

Another lawyer representing Tinubu, Oluwole Afolabi, also welcomed the outcome, noting that the court had clarified several procedural questions without bringing the substantive dispute to a conclusion.

### Court Rejects Other Applications

Beyond the request involving Tinubu and DCI Group, the American court also dismissed additional applications connected with the proceedings.

One involved Karl Von Batten, who had sought permission to submit an amicus curiae brief, commonly described as a friend-of-the-court submission.

Such briefs are generally filed by individuals or organisations that are not direct parties to litigation but believe they can provide relevant legal arguments or information.

The court also rejected Greenspan’s related request for judicial notice and denied his motion for summary judgment.

A summary judgment application ordinarily asks a court to decide a case, or particular legal issues, without proceeding to a full trial where no material factual dispute requires one.

The rejection means Greenspan did not obtain the judgment he sought through that application.

### FBI and DEA Records Remain at Centre of Legal Battle

Despite the latest procedural decision, the broader controversy surrounding access to American government records relating to President Tinubu remains unresolved.

The litigation originated from information requests submitted by Greenspan and Nigerian journalist David Hundeyin to several United States government agencies between 2022 and 2023.

The requests sought records concerning Tinubu and other individuals in connection with historical American law-enforcement investigations.

The agencies involved in the wider proceedings include the FBI, DEA and other federal institutions.

The case has generated controversy over the extent to which records connected with past investigations can be released under American freedom-of-information laws.

Some documents have been produced with redactions, while other materials remain subject to legal restrictions and judicial examination.

Tinubu’s legal representatives have previously raised privacy concerns over the proposed disclosure of certain investigative records.

The dispute therefore involves competing legal considerations, including public access to government information, personal privacy and exemptions protecting sensitive law-enforcement material.

### What the Ruling Means for Tinubu

Although the latest court decision is favourable to President Tinubu, its legal implications must be distinguished from a final judgment on the underlying controversy.

The court did not determine that every document sought by Greenspan must remain confidential.

Neither did it conclusively resolve the legality of the withholding or redaction of records by American federal agencies.

Instead, the October 30 decision addressed particular applications, including the attempt to obtain evidence concerning alleged cyberattacks.

For Tinubu, the ruling removes an immediate procedural challenge that could have required further engagement with allegations outside the principal FOIA dispute.

For Greenspan, it narrows the avenues available within the existing proceedings to pursue questions about the alleged cyberattacks.

Nevertheless, the substantive litigation concerning access to government records continues.

### Attention Shifts to Next Stage of US Litigation

With the latest applications rejected, attention is expected to return to the central question of whether American authorities have complied with their obligations under the Freedom of Information Act.

The court will still have to address outstanding issues concerning the records sought, including whether applicable legal exemptions justify withholding particular information.

The eventual determination could have implications for the extent of public access to the documents at the centre of the case.

For now, President Tinubu has secured a favourable procedural ruling, but the wider legal battle over the release of FBI and DEA records has not reached its conclusion.

The development underscores the distinction between winning an individual application and obtaining a final judicial resolution of an entire lawsuit.
