Alia Raises Alarm Over Garnishee Orders, Warns Benue Development Funds at Risk

Benue State Governor, Rev. Fr. Hyacinth Alia, has raised the alarm over huge financial awards arising from garnishee proceedings against state and local government accounts, warning that continued deductions could undermine the government’s ability to fund critical development programmes.

Alia expressed the concern at the Benue State High Court Headquarters in Makurdi during a special court session marking the commencement of the 2026/2027 Legal Year.

The governor’s intervention has brought renewed attention to the potential impact of court-ordered deductions on public finances at a time when the state government is seeking resources for infrastructure, security, healthcare, education and other essential services.

Alia called for greater cooperation between the Executive and Judiciary in dealing with matters capable of affecting the state’s finances and development agenda.

He maintained that both arms of government should not operate as rivals but as partners with a common responsibility to protect the interests and welfare of the people.

The governor urged judicial officers, lawyers and other stakeholders in the justice sector to uphold professionalism, fairness and integrity in the discharge of their responsibilities.

According to him, adherence to professional ethics and preservation of the dignity of the legal profession are essential to maintaining public confidence in the administration of justice.

Alia also called for greater efforts to tackle delays in the determination of cases, stressing the importance of ensuring that litigants receive fair and timely hearings.

He said Benue requires a justice system that is accessible, efficient, independent and responsive to the needs of citizens.

According to the governor, the state’s aspirations in economic development, investment, security, healthcare, education and social advancement cannot be fully realised without a stable and effective legal and institutional environment.

His warning over garnishee proceedings comes amid growing attention to the issue in Benue, with the State House of Assembly recently moving to investigate alleged indiscriminate garnishee orders against government accounts.

The Assembly constituted a five-member ad hoc committee to examine the circumstances surrounding the orders and judgment debts involving the state government and local government councils.

The development has placed the relationship between enforcement of lawful judgments and protection of public finances under increased scrutiny.

While judgment creditors are legally entitled to pursue enforcement of valid court decisions, large deductions from government accounts could have implications for budget implementation and the delivery of public services.

Alia’s position is that the judiciary and executive must find ways of ensuring that justice is served without creating financial consequences capable of frustrating the government’s broader developmental responsibilities.

Speaking at the event, the Chief Judge of Benue State, Justice Maurice Ikpambese, challenged judicial officers and members of the Bar to remain resolute in administering justice and resist practices capable of eroding public confidence in the judiciary.

Ikpambese urged members of the Bench and Bar to reject frivolous applications and unnecessary adjournments that could prolong cases and deny litigants timely justice.

Benue State Attorney-General and Commissioner for Justice, Professor Timothy Yangien, said the theme of the 2026/2027 Legal Year, “The Nigerian Judiciary at a Crossroads: Innovation, Accountability and Public Trust,” reflected some of the major challenges confronting the country’s justice system.

With both the Executive and Legislature now expressing concern over garnishee orders affecting government accounts, attention is expected to shift towards how Benue will address outstanding judgment debts while ensuring that legitimate court decisions are respected and public funds required for essential services remain protected.
