Court Dismisses NDC Suit Challenging Electoral Act 2026 Ahead of 2027 Elections
The Federal High Court in Abuja has dismissed a suit filed by the Nigeria Democratic Congress (NDC) challenging provisions of the Electoral Act 2026, reaffirming the validity of the law ahead of preparations for the 2027 general elections.
The NDC had approached the court seeking to invalidate Sections 138 and 77(5) of the Electoral Act 2026, arguing that the provisions were inconsistent with the 1999 Constitution (as amended). The party contended that the disputed sections could undermine democratic participation and the electoral process if allowed to remain in force.
In its ruling, the court struck out the suit, effectively ending the legal challenge and leaving the contested provisions of the Electoral Act intact. The judgment means the Electoral Act 2026 remains the governing legal framework for the conduct of elections, political party activities and candidate nominations across the country.
The ruling is considered significant as political parties, the Independent National Electoral Commission (INEC), and other stakeholders intensify preparations for the 2027 general elections. Legal analysts say the decision reinforces the existing electoral framework unless any future amendment is made by the National Assembly or a higher court reaches a different conclusion.
The judgment is expected to provide greater legal certainty for the electoral process while underscoring the judiciary’s role in resolving constitutional disputes relating to Nigeria’s electoral laws.
